1. Binding Agreement: This Agreement sets forth the terms and conditions under which the Member,  shall have access to martial arts instruction and classes provided by SBG MORAY MARTIAL ARTS, also referred to as the School or the gym from here. 

By signing below, Member agrees to be bound by all of the terms and conditions set forth in this Agreement.

2. Term: The initial term of this Agreement shall begin on the date of signature . Until terminated by either the member or " The gym ", after the Initial Term, this Agreement shall continue in effect on a month to month basis. until 30 days after Member delivers written notice of termination to the School 

Each Subsequent Monthly Term shall begin on a monthly anniversary of the signature date and end at the close of business on the day immediately prior to the next monthly anniversary of the Effective Date. (You can adjust termination notice from 30 days to your preference. Also remove parts as meets 

3. Termination: This Agreement may be terminated by SBG MORAY (i) at any time if Member breaches this Agreement; or for any reason including SBG MORAY MARTIAL ARTS discretion

This Agreement may be terminated by Member (or Member’s estate) by delivering written notice of termination to SBG MORAY MARTIAL ARTS , at the address set forth above 

 4. Pricing: The School offers a membership dependant on the age and classes an individual wishes to attend for a stated price in our membership options.

5. Payment: As of the Effective Date, Member has paid to the School the sum of membership which covers the period beginning on the signature date, rolling monthly or untill the end of the payment term. 

By signing this agreement and agreeing to direct debits to be taken and hereby authorises  direct debits to be taken on the agreed date. the School or its agents to charge the payment to the Member automatically.

6. Instruction: Member’s ability to attend classes and receive instruction is on the condition of the School’s receipt of the Payment for such classes. The School shall have the right to suspend Member’s membership at any time and from time to time during any period that Member is not current in the Payment.

All instruction shall be provided at the coaches at the SBG MORAY GYM or at such other location determined by the School in its sole discretion. All instruction shall be offered at such times as determined by the School in its sole discretion. The School reserves the right to change its class schedule or the frequency thereof at any time and from time to time without advance notice to the Member.

7. Policies and Rules: Member hereby acknowledges that the Member has read and understands the School’s rules and procedures. The Member further acknowledges that the School has the right to change the School Rules at any time and for any reason. The Member hereby agrees to comply with and be bound by the School Rules, as the same may be amended from time to time.

8. Representation of the School. Member agrees that Member shall not, without the prior written consent of the School, hold himself or herself out publicly as representing the School in any manner, including, but not limited to, as a professional or amateur fighter, in martial arts or other combat tournaments,

 RELEASE OF LIABILITY. (a) The Member acknowledges that participation in martial arts instructional classes and activities involves intense, stressful and strenuous exercise and physical contact, which carry with them a high degree of risk and can result in serious physical or emotional injury, including, but not limited to, paralysis, death, bruises, bloody noses, unconsciousness, soft tissue damage, broken bones, heart attacks and other cardiovascular injury, and other serious damage to person or property. The Member further acknowledges that such risks cannot be eliminated without jeopardizing the essential qualities of the activity. (b) The Member confirms that the Member is aware of the above risks as well as other risks associated with participating in martial arts instruction and the martial arts, and that member is hereby assuming such risks voluntarily. (c) The Member hereby releases and agrees to indemnify and hold the school and its officers, directors, managers, members, partners, employees and agents and their respective affiliates harmless from any and all claims and liabilities of any kind or nature arising out of, or related to, member’s participation in the school’s classes and curriculum and the martial arts, including, but not limited to, any claims based on the school’s negligence.

The Member certifies that the Member has, and at all times during the term will have, adequate insurance to cover any injury or damage suffered as a result of attending school classes or participating in the martial arts. alternatively, Member certifies that the Member has, and during the term will continue to have, the means to self insure against such injury or damage.

The Member further certifies that the Member has no medical condition which could interfere with the Member’s safe participation in school classes or the martial arts. 

10. Counterparts; Facsimile Signatures: This Agreement may be executed in one or more counterparts and delivered by facsimile signature, each of which shall be considered an original and all of which, together, shall be deemed one and the same agreement.

11. Entire Agreement: This Agreement constitutes the entire agreement between the Member and School with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings with respect thereto, whether oral or written. 

12. Severability: In the event that any provision of this Agreement or the application thereof, becomes or is declared to be illegal, void or unenforceable, the remainder of this Agreement will continue in full force and effect. The parties further agree to replace such void or unenforceable provision with a valid and enforceable provision that will achieve, to the extent possible, the economic, business and other purposes of such void or unenforceable provision.

13. Legal Fees; Cost of Collection. In the event of any dispute arising out of this Agreement, Member does not pay any amount payable hereunder when due, Member shall pay any and all collection costs, including, but not limited to, reasonable attorneys’ fees and costs, incurred by the School. By Member’s signature below, Member acknowledges that Member has received a copy of this Agreement and has read and understands the terms and conditions of this Agreement and agrees to be bound by such terms and conditions.

YOU, THE MEMBER OR CARETAKER OF MEMBER, MAY CANCEL THIS AGREEMENT AT ANY TIME , YOU MUST INFORM THE CLUB OF YOUR WISH TO CANCEL AND YOU ARE RESPONSIBLE FOR MANAGING YOUR DIRECT DEBITS, REFUNDS ARE SUBJECT TO DISCRETION. sbgmoray@icloud.com

Hi SBG Moray Child Safeguarding and Protection.

 
SBG Moray is dedicated to providing a secure and safe learning environment for children. This document outlines the measures taken by SBG Moray to minimize the risk of harm to children who participate in activities at our facility. 

• • SBG Moray is a member club of the UK Brazilian Jiu Jitsu Association (UKBJJA). Our staff and coaches are insured through the UKBJJA, and they fully comply with the association's standards for instructors, including undergoing PVG checks. SBG Moray meets all the criteria set forth by the UKBJJA for member clubs and actively engages in the provided training. Our head coach, Martin Donaldson, is an active Police officer with 13 years of service in Police Scotland. Therefore, we possess the necessary expertise to handle all matters concerning member safety adequately.

• • All coaches at SBG Moray possess more than a decade of experience in martial arts training and competition. We take pride in delivering excellent quality coaching and remain committed to continuous coach development within the sport. In return, we believe our coaches can offer the highest quality service and cater to a wide range of children and adults. Our experienced coaches ensure that the techniques taught are both safe and appropriate for all participants. Whenever possible, classes are divided into age groups to provide the best possible experience for children.

• • At SBG Moray, we foster an environment of inclusivity. We actively encourage children to report any concerns they may have about their safety and well-being. We also urge children to speak to their parents or coaches if they encounter instances of bullying or inappropriate behavior. Reports of bullying or inappropriate and intimidating behavior are treated with seriousness and confidentiality, with consideration for all parties involved. Should we be concerned about a childs behaviour we will speak with the parents in regards to this.

• • All club members, staff, coaches, and volunteers are expected to uphold appropriate professional and ethical standards of conduct at all times. We recognise that physical contact is necessary in martial arts, but it should be strictly limited to training requirements. No member, staff, coach, or volunteer shall engage in any behavior that could pose a risk to child safety or violate ethical or professional boundaries.

• • We encourage all club members, staff, coaches, and volunteers to promptly report any incidents or concerns related to child safety and well-being to a trusted club member. The safety and well-being of children are of paramount importance to us, and as such, the club will respond promptly to investigate and address any reported concerns.

• • SBG Moray may use photographs or videos of students training for promotional purposes on social media. However, parents or guardians have the right to request that their child's image not be used.

• • SBG Moray reserves the right to cancel the membership of any individual who poses a risk to the safety of others.

• • Our club is committed to regularly reviewing and updating this policy to ensure that all club members, staff, coaches, and volunteers adhere to and implement it effectively.

In conclusion, the safety and welfare of children involved in our martial arts club are of paramount importance. We are fully dedicated to creating an environment that is safe, inclusive, and free from any form of intimidation or abuse.
